What Is eIDAS?

eIDAS is the European Union framework for electronic identification and trust services used in electronic transactions. It establishes rules for electronic signatures, electronic seals, time stamps, registered electronic delivery, website-authentication certificates, and qualified trust services.

The framework is intended to improve confidence in digital transactions and support cross-border recognition across the EU. The amended European digital-identity framework also expands the broader ecosystem for trusted electronic identification and credentials.

Legal Recognition of Electronic Signatures

Under eIDAS, an electronic signature cannot be denied legal effect or admissibility as evidence solely because it is electronic or because it does not meet qualified-signature requirements. The evidentiary weight of a particular signature still depends on the facts, assurance level, and applicable law.

A Qualified Electronic Signature is expressly recognized as having the equivalent legal effect of a handwritten signature throughout the EU.

eIDAS regulates more than electronic signatures. Its trust-service framework supports multiple forms of electronic evidence and authentication.

Qualified Trust Service Providers

A Qualified Trust Service Provider (QTSP) delivers one or more qualified trust services after assessment and supervisory approval under eIDAS. Qualified status is associated with formal requirements, oversight, and inclusion in an applicable trusted list.

One objective of eIDAS is to support consistent recognition of regulated trust services across EU Member States. A qualified electronic signature based on a qualified certificate issued in one Member State must be recognized as a qualified electronic signature in the others.

Recognition of a document or transaction can still depend on sector-specific law, document formalities, authority requirements, and the circumstances of the transaction.

Does eIDAS make every electronic signature legally equivalent to handwriting?

No. Electronic signatures cannot be rejected solely because they are electronic, but only a valid QES is expressly given handwritten-signature equivalence across the EU.

Which eIDAS signature level should I use?

Choose the level based on law, document type, identity risk, value, dispute exposure, and counterparty requirements. Higher assurance is not automatically necessary for every transaction.
